A relevant Bill ‘On Amendments to the Land Code of Ukraine (appertaining to the Sale of Land Plots exclusively at Auction)´ is under consideration in the Agrarian Policy and Land Relations Committee.
The Bill (Reg.No.1392) envisages that a new provision is added to the Transitional Provisions of the Land Code of Ukraine, reading that until a Law on the Procedure for land sale has been adopted, such Auctions shall be conducted using the procedure as established by The Cabinet of Ministers of Ukraine.
The Sponsor of this Bill, People's Deputy, O.Feldman, notes that the Law, 'On The State Budget of Ukraine 2008 and on Amendments to Several Legislative Acts of Ukraine', has amended the Land Code of Ukraine, establishing the conditions for the sale of Land Plots in State and Municipal ownership to individuals, legal entities and business entities at auction. At the same time, he adds, pursuant to Clause 137 of The Land Code of Ukraine, Land sale should be conducted using a procedure laid down in Law.
Hence, stresses O. Feldman, the Law requires that Land Plots in State and Municipal ownership are sold through auctions, the procedure for which should be established in by Law, however not establishing this procedure.
The People's Deputy draws attention to the Bill, 'On the Land Market' (Reg. No.2600-1), passed at the First Reading, which will regulate the sale of Land Plots at Auction.
Whereas the date of the adoption of this Law is indefinite, there is an urgent requirement to have the procedure for the sale of land in State and Municipal ownership regulated, the Sponsor suggests that the Cabinet of Ministers is commissioned to adopt the procedure for conducting land auctions.
The Sponsor believes that the passing of this Bill will result in land plots in State and Municipal ownership being sold exclusively through auctions, which will lead to higher revenues for Local Budgets from their sale.
